PHOTOHOLIDAYSFRANCE TERMS & CONDITIONS
1. A non-refundable deposit of the amount stated is payable in pounds sterling at the time of booking and must be sent by the client with the completed booking form. Photoholidaysfrance will confirm its acceptance of the booking and it is this acceptance which constitutes a binding contract between the parties incorporating these terms and conditions.
2. The balance of the stated cost is payable in pounds sterling 10 weeks prior to the stated departure date and if not so received by that date Photoholidaysfrance reserves the right to cancel the booking and retain the deposit.
3.All payments received from the client will be held by Photoholidaysfrance in a Trust Account for the benefit and protection of the client.
4. Cancellation :-
4.1. by the client : must be by written notice and is effective
upon the date of its receipt by Photoholdaysfrance
which date determines
the percentage of the
cost refundable to the client which is : 56-42
days before departure 50%;
41-28 days before departure 25%;
27 days or less before
departure 0%.
4.2. by Photoholidaysfrance : must be by written notice and will
be followed within 7 days by a refund of 100%
of all monies paid by the
client to Photoholidaysfrance
(save in the case of cancellation
pursuant to clause 2) and will only be given in the events of either force
majeure when it will be immediate or of underbooking (ie. the minimum number
of bookings to run the course is not made) when it will be not
less than 28 days prior to the stated departure date.
5. The client is responsible for all UK travel and flight booking
arrangements and accordingly :-
5.1. a client arriving or departing on flights different from
those stated will be responsible for his or her own transfer costs or additional
travel expenses
5.2. Photoholidaysfrance is not responsible for any expenses
loss or other damage caused to the client by the acts or
omissions of the
carrier or delay or interruption
of travel services for any reason whatsoever
5.3. as Photoholidaysfrance is not a party to any flight
bookings made by the client and has received no payment for the same
Photoholidaysfrance
will not refund the costs of any flight in the event of cancellation pursuant
to clauses 2 or 4.
6. The client will obtain the appropriate travel insurance cover before the departure date which must cover all loss expenses and damages arising from, including but not limited to, the cancellation of the course (whether in whole or in part) personal accident and injury, medical and repatriation costs, loss of baggage and personal money and belongings, and flight cancellations and delays.
7. The client must possess a valid passport and all visas permits and certificates including medical certificates required for the journey and hereby accepts responsibility for the same.
8. As the course is also designed as a holiday it requires flexibility and Photoholidaysfrance accordingly reserves the right to alter the cost services or other particulars but will advise the client of any material alteration (in advance if possible) and the client accepts that these and the outline itinerary and course details are proposals to which Photoholidaysfrance will endeavour to adhere or improve but without a specific contractual obligation so to do.
9. Photoholidaysfrance disclaims any responsibility or liability for the
death injury or illness of the client unless arising directly from the
negligent
act or admission of Photoholidaysfrance and the client hereby accepts this
disclaimer and thereby signifies that he or she hereby
releases Photoholidaysfrance
and its principals agents employees and associates from all liability costs
claims actions and demands arising
directly or indirectly out of his or her
participation in the course.
10. All or any claims or disputes arising out of this contract shall be subject to English Law and the jurisdiction of the English courts.
